It is much easier to address a problem before the contract becomes unconditional than to try to solve it shortly before possession.<\/p>\n\n\n\n<p>Do not sign a contract you do not fully understand. The title is the official government record that identifies the registered owner and shows certain registered interests affecting the property.<\/p>\n\n\n\n<p>When an existing home is sold, its title must be transferred from the seller\u2019s name into the buyer\u2019s name. The Government of Alberta confirms that an existing home\u2019s land title must be transferred to the purchaser following a sale. (Alberta.ca)<\/p>\n\n\n\n<p>A Transfer of Land document is used to change ownership. It must be properly prepared, signed and submitted for registration through Alberta Land Titles. Alberta Land Titles notes that transfers are governed by the Land Titles Act and advises people to obtain legal assistance because staff cannot help complete complex transfer documents. The lawyer helps ensure that:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The registered owner is legally able to sell the property<br><\/li>\n\n\n\n<li>The legal description matches the home you agreed to purchase<br><\/li>\n\n\n\n<li>Existing mortgages and other financial registrations are addressed<br><\/li>\n\n\n\n<li>Your mortgage is registered correctly<br><\/li>\n\n\n\n<li>Your name is placed on the new title accurately<br><\/li>\n\n\n\n<li>Purchase funds are handled securely<br><\/li>\n\n\n\n<li>The seller\u2019s lawyer receives the required funds<br><\/li>\n\n\n\n<li>Ownership is registered in accordance with the transaction<br><\/li>\n<\/ul>\n\n\n\n<p>This protects you from paying for a home without receiving legally registered ownership.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_Your_Real_Estate_Lawyer_Does_Before_Closing\"><\/span><strong>What Your Real Estate Lawyer Does Before Closing<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Once the purchase contract is firm, your lawyer will usually receive documents from your real estate agent, lender and the seller\u2019s lawyer.<\/p>\n\n\n\n<p>The lawyer reviews the current title and identifies registered items that may affect the transaction. These may include the seller\u2019s mortgage, utility rights of way, restrictive covenants, caveats or other registrations.<\/p>\n\n\n\n<p>Not every registration is necessarily a problem. Many Calgary properties have standard utility or community registrations. Mortgage registration is also subject to Land Titles charges. These government fees are separate from your lawyer\u2019s professional fee and may change over time. Real estate transactions are targets for payment-redirection fraud.
